1. Who we are

Zachicom (“Zachicom,” “we,” “us,” or “our”) operates the website zachicom.com and a software platform for landscaping and field-service businesses. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our website, request information or a walkthrough, communicate with us by email or phone, use our platform as a customer company, or receive SMS or similar messages from or on behalf of Zachicom or your employer (our customer) in connection with our services.

2. Information we collect

We may collect:

  • Contact and business details you submit on our forms or send to us directly, such as your name, company name, work email address, optional phone number, optional company website URL, and similar fields you choose to provide.
  • Communications content when you email us or exchange messages with our team, including message metadata (for example timestamps and routing information).
  • SMS and messaging program information when you interact with our marketing or product messaging, including mobile telephone numbers, consent and preference records (where applicable), message delivery status, and opt-out or help requests.
  • Customer account and workforce data when a company uses our platform: for example, information the customer’s owner or authorized administrators enter about jobs, crews, and employees, including phone numbers the customer supplies for employees so we can deliver operational messages (for example scheduling, dispatch, job updates, and account notices) as authorized under the Customer Agreement (as defined in our Terms of Service).
  • Technical data automatically sent by your browser or device, such as IP address, device type, browser type, general location derived from IP, and pages visited, as needed to operate and secure the site and the platform.

3. How we use information

We use information to:

  • Respond to inquiries, schedule walkthroughs, and provide customer support.
  • Operate, maintain, secure, and improve our website and platform, including delivering features the customer has purchased.
  • Send transactional or service-related messages (for example confirmations, scheduling updates, and account notices).
  • Send SMS and similar messages where permitted by law and consistent with the Customer Agreement and any consent or instructions collected at signup, in the product, or at the point of message enrollment. For employee recipients, messages are generally sent because your employer (our customer) uses Zachicom and has provided your number for workforce and operations communications under their contract with us—not for unrelated third-party advertising from Zachicom.
  • Comply with law, enforce our agreements, and protect rights, safety, and security.

4. Customer agreements and employee phone numbers

When a business becomes a Zachicom customer, an owner or other authorized signatory for that business enters into our Customer Agreement (either by accepting our Terms of Service at checkout or by executing a separately signed agreement, as applicable). That agreement includes terms under which the customer authorizes Zachicom to send operational messages to telephone numbers the customer provides, including numbers associated with employees, to operate the service the customer purchased. Employees who receive such messages should direct workplace-related questions to their employer’s management and may contact Zachicom using the email below for privacy questions about how we handle information in our role as a service provider to their employer.

5. Mobile numbers and SMS — how we share data

We use mobile numbers and SMS-related data to deliver messages you or your employer have agreed to receive (including under the Customer Agreement) and to operate our services. We do not sell or share mobile numbers with third parties for their own marketing purposes. We may share information with service providers who help us deliver messages, host infrastructure, or provide communications tools (for example a telecommunications or messaging platform), only as needed for them to perform services on our behalf and subject to appropriate confidentiality and security obligations. We may also disclose information if required by law, legal process, or to protect the rights, privacy, safety, or property of Zachicom, our customers, you, or others.

6. Message frequency and charges

Message frequency depends on the type of communication: marketing and walkthrough-related texts are typically infrequent; operational messages tied to active work (for example dispatch and schedule changes) may be more frequent during busy periods and reflect how the customer uses the platform. Message and data rates may apply depending on your mobile carrier and service plan. Carriers are not liable for delayed or undelivered messages.

7. Your choices and controls

You may:

  • Opt out of promotional emails by using an unsubscribe link where provided, or by contacting us at the email below.
  • Opt out of or manage SMS messages using the instructions provided in the relevant message program (for example replying STOP where supported for marketing or non-transactional texts). Reply HELP for assistance where supported. Operational texts to employees may be controlled through employer policies and product settings, subject to law and your employer’s agreement with Zachicom.
  • Request access, correction, or deletion of certain personal information, subject to legal exceptions and our role relative to your employer’s account, by contacting us using the email below (and, where appropriate, contacting your employer).

8. Cookies and similar technologies

We may use cookies or similar technologies that are necessary to operate the website (for example security, load balancing, or basic functionality). If we introduce optional analytics or non-essential tracking, we will update this policy and provide any required choices before those technologies run.

9. Data retention

We retain information for as long as needed to fulfill the purposes described in this policy, operate our business, resolve disputes, enforce agreements (including Customer Agreements), and comply with legal obligations.

10. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure.

11. Children

Our services are intended for businesses and adults. We do not knowingly collect personal information from children under 16.

12. International users

If you access the site from outside the United States, you understand your information may be processed in the United States or other countries where we or our service providers operate.

13. Governing law and venue

This Privacy Policy and any dispute arising out of or relating to it or the zachicom.com marketing site are governed by the laws of the State of Michigan, without regard to its conflict-of-law principles, except where prohibited by applicable law. To the fullest extent permitted by law, the state and federal courts located in Michigan have exclusive jurisdiction over such disputes, and you consent to personal jurisdiction there.
